I think .460 is too high of a cutoff to penalize people. An average of 73 wins would be just below the .460 cutoff and I think a person could be under that if they were trying and had legitimate bad luck.

I also think that penalizing by taking draft picks is hard to do because draft picks are traded during the season. How do you take away a pick that is traded to another team?
